First Principle: Different Obligations, Different Tools
The critical distinction in Florida enforcement is between support obligations (child support, alimony) and property division obligations (equalizing payments, transfers, debt assignments). Support is enforceable by contempt — the court’s power to coerce compliance with its orders, up to incarceration — because support flows from the court’s ongoing authority. Property division obligations, once reduced to a money judgment, generally are not contempt-enforceable — imprisonment for debt is constitutionally barred — and instead run through civil collection: liens, garnishment, levy, execution. Enforcing Property Division: The Collection Track
When the obligation is money or property, the toolkit is civil but muscular: reduce it to judgment (if the decree did not already) and record certified copies to create liens on real property in any county where the ex owns land; garnish wages and bank accounts; levy and execute on non-exempt personal property; and conduct proceedings supplementary — post-judgment discovery under oath into assets, transfers, and income, with the power to unwind fraudulent conveyances made to dodge the judgment. For unexecuted transfers, Florida procedure has an elegant fix: where a party refuses to sign a deed or title document the judgment requires, the court can enter an order that itself operates as the conveyance, or appoint the clerk to execute in the defaulter’s place — the house gets deeded whether or not the ex ever picks up a pen. Certain obligations need their own maps.
