Child abuse in Florida

Florida Statute § 827.03(2)(c) explains child abuse as an act of intent that can physically or psychologically harm a child, or an act that could be expected to harm a child. It may also be almost any person’s active encouragement to commit an act that results in or could reasonably be expected to result in a child being physically or mentally injured.

Child abuse doesn’t have to come from a parent, legal guardian or other person entrusted with the well-being of the child; what could constitute a battery of misdemeanor on an adult victim can be charged as child abuse if the victim is under the age of 18.

Consequences

If a first-time offender in Florida is found guilty of child abuse, he or she may face up to a maximum of 15 years in prison. If no serious bodily harm or permanent disfigurement or disability has occurred, this offense is charged as a 3rd degree felony. Penalties may include a $10,000 monetary penalty, too. If the defendant has been convicted twice before on charges of aggravated child abuse, however, the punishment becomes harsher. The defendant can then face a prison sentence of at least 15 years, or more.
